DB upholds detention of narco smuggler

JAMMU, July 24: A Division Bench of Jammu & Kashmir and Ladakh High Court comprising Acting Chief Justice Tashi Rabstan and Justice Rajnesh Oswal has dismissed the petition filed by Anil Singh, who was detained under PITNDPS.
After hearing Advocate GS Thakur for the appellant whereas AAG Amit Gupta for the UT, DB observed, “merely mentioning of wrong statute in the order for executing the order of detention passed by the Detaining Authority would not vitiate the order of detention passed by the Detaining Authority, which is otherwise found to be in accordance with law”.
DB examined the judgment passed by the writ court and do not find any reason so as to warrant interference. “The Single Judge has considered and dealt with all the contentions raised by the appellant in accordance with law”, DB said and dismissed the appeal as there was no merit in the same.
