DB’s directions on migrant pharmacists’ transfer

JAMMU, Nov 28: Division Bench of State High Court comprising Chief Justice M M Kumar and Justice Mohd Yaqoob Mir disposed of a Letters Patent Appeal (LPA) filed by migrant Pharmacists with certain directions.
In the LPA filed by Maharaj Krishan Raina and other migrant Pharmacists, it was submitted that on their promotion they were transferred to Kashmir valley. The transfer orders were challenged in the Writ Court. However, the petition was dismissed and the petitioners knocked the doors of the Division Bench.
After hearing Senior Advocate Sunil Sethi assisted by Advocate Veenu Gupta whereas Advocate C M Koul for the caveator, the Division Bench set-aside the judgment of Writ Court and disposed of appeal with a direction to the respondents to give effect to the promotional orders in respect of the appellants and post them wherever the posts are available as per the administrative exigency. The DB also directed the respondents that the needful shall be done within a period of four weeks.
