DB’s directive on promotion of DC Srinagar

JAMMU, Aug 4: Division Bench of State High Court comprising Justice Dhiraj Singh Thakur and Justice Bansi Lal Bhat today directed that any benefit granted to Farooq Ahmed Shah, Deputy Commissioner Srinagar, in terms of future promotion and induction shall be subject to outcome of the LPA filed by KAS officer Rohit Khajuria.
In the LPA, Rohit Khajuria, Executive Director Mubarak Mandi Heritage Society has challenged the judgment of Writ Court whereby his petition was dismissed with costs Rs 20,000.
The grievance of Rohit Khajuria is that Government vide Order dated September 4, 2013 placed Farooq Ahmed Shah, Deputy Commissioner Srinagar in the Super Time Scale of KAS despite the fact that respondent was junior to the petitioner. Through the LPA, Rohit Khajuria is seeking direction to the respondents to recommend his name for induction into IAS.
After hearing Advocate DK Khajuria appearing for the appellants whereas Advocate WS Nargal for Farooq Ahmed Shah, Division Bench summoned the record from Srinagar Wing of the High Court and directed Registry to list the LPA after three weeks.
The DB made it clear that any benefit granted to Farooq Ahmed Shah in terms of future promotion and induction shall be subject to outcome of present proceedings.
