DC Kathua warns strict action against encroachers of water bodies

KATHUA, Dec 1: District Development Commissioner Kathua, Rohit Khajuria has warned strict action against the encroachers of State land especially the land under water bodies.
In an order issued here, today, the DC Kathua also warned that any mutation or entry in revenue record on any water bodies after the issuance of this order will be considered null and void and any construction raised on any water resource will be demolished at the cost of the encroacher.
The order says that large number of water bodies including on ponds, khools, rivers, wells etc are found to be encroached upon in the district. The order said under the Section 3 of J&K Water Resources (Regulation & Management) Act every water resource in the State is and will remain the property of the Government and any proprietary ownership or any riparian or usage right on such water resources vested in any individual, group of individuals or any other body, corporation, company, society or community will be deemed to have been terminated and vested with the Government from the date of commencement of the Act.
While quoting the order of State High Court in this regard, DC Kathua said a Division Bench of State High Court in the case of Dharam Chand and others V/S State of J&K through its Chief Secretary has directed the respondents to ensure that all water bodies and public utilities are cleared of all encroachments.
Rohit Khajuria warned that no person should use any water from any source (surface or ground) or collect or extract any material from such water resources except in accordance with the provisions of the Act.
