Delhi court denies bail to S S Wazir

JAMMU, July 15: Additional Sessions Judge Tis Hazari Court Delhi has denied bail to Sudershan Singh Wazir in the murder case of former MLC Tarlochan Singh Wazir.
“The accused is an influential man and there cannot be any second opinion regarding the same. He has been an MLC and member of Gurudwara Prabandhak Committee in Jammu and Kashmir”, the court said, adding “if he is released on bail, he may tamper with the evidence and influence the witnesses as well”.
“The prosecution has also filed a letter from Jammu Police that prosecution witness Gulshan has been threatened. Although it is correct that prosecution has not filed complaint of this but the fact remains that there is a threat perception to witness and the accused being an influential man of means can threat this witness as well”, the court said, adding “moreover, other public witnesses as well may be threatened if the accused is released on bail”.
The court further said, “the most important aspect, while considering the regular bail application of accused under Section 439 CrPC, are the gravity and seriousness of the offence as well as severity of the punishment”, adding “the offence under Section 302 IPC is the most serious and grave offence in the IPC. In case of conviction, accused shall be liable to suffer at least life imprisonment. Hence, this consideration goes against the accused”.
“I am of the considered opinion that at this stage no ground for bail is made out. Accordingly, the bail application under Section 439 CrPC of accused is dismissed”, the Judge said.
