Encroachment by Minister

JAMMU, Sept 7: In an alleged complaint filed by Ankur Sharma regarding encroachment of 10 kanals forest land by Minister for Transport Abdul Ghani Kohli at Nowabad (Sunjwan), which was treated as Public Interest Litigation, Division Bench of State High Court comprising Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal today granted three weeks time to AAG for filing status report.
When the PIL came up for hearing, the petitioner, while referring to his complaint filed before the Director, State Vigilance Organization, submitted that as per directions of Supreme Court in case titled Lalita Kumari Versus State of UP, the Vigilance Organization was under an obligation to register FIR against Minister as his complaint discloses the commission of cognizable offences or in the alternative SVO should have finalized the preliminary enquiry within seven days as prescribed by Apex Court.
“Neither the FIR was registered nor the preliminary enquiry finalized solely because of the reason that the accusations were directed against high profile sitting Minister”, he said and pressed for the constant monitoring of the ongoing preliminary enquiry by State High Court looking into the gravity of the allegations and position enjoyed by the encroacher.
