Endoscopy Machine to remain in GMC: HC

JAMMU, Mar 8: While refusing to quash the order of shifting Endoscopy Machine from Superspecialty Hospital to Government Medical College Jammu, High Court today said that State is at liberty to proceed against Dr Showkat Choudhary with regard to alleged misconduct committed by him.
“So far as the relief claimed by the petitioner with regard to shifting of Endoscopy Machine and quashment of order dated 18-04-2016 are concerned, it would be profitable to refer to the averments made by the respondents in their reply”, Justice Alok Aradhe said.
The respondents have stated that in Government Medical College 250-300 procedures are performed on Endoscopy Machine per month whereas in Super Specialty Hospital only 50 procedures are performed per month.
Justice Aradhe further observed, “the petitioner neither has any statutory nor any legal right over the Endoscopy Machine as the petitioner is not owner of the Endoscopy Machine”, adding “in the absence of any statutory right vested in favour of the petitioner, it cannot be said that there has been infraction of the legal or statutory right which has accrued to the petitioner”.
“The State would be at liberty to proceed against the petitioner with regard to his alleged misconduct in accordance with law”, the High Court said.
