Ensure impartiality, equity in discharge of duties: Justice Massodi to Executive Magistrates

SRINAGAR, July 5: Under the guidance and patronage of Chief Patron of State Judicial Academy, Justice N. Paul Vasanthakumar, Chief Justice, High Court of Jammu and Kashmir and  Committee of Judges, State Judicial Academy (Justice Muzaffar Hussain Attar, Chairman and (Justice Hasnain Massodi, Member),    Jammu and Kashmir State Judicial Academy today conducted one day refresher course for Tehsildars/Naib-Tehsildars (Executive Magistrates), Deputy Commissioners, Sales & Commercial Tax Department, Deputy & Assistant Commissioners of Excise Department and Deputy and Assistant Commissioners of Labour Department of Kashmir province.
Justice Hasnain Massodi presided over the programme. The programme was conducted by Pawan Dev Kotwal, Director, State Judicial Academy.
Justice Massodi deliberated on the topic “Principles of Natural Justice and Conduct of the Officers in discharge of their judicial/quasi-judicial functions” at length. He observed that there is no statute laying down the minimum procedure which executive agencies must follow while exercising decision-making powers but every statutory law and rules enacted and framed to achieve the goals enshrined in the preamble of the Constitution.
In order to achieve these goal officers have to afford opportunity of being heard while taking any decision adversaly affecting the rights of any individual. He quoted various instances to make the participants understand the standards of fairness, transparency, impartiality, equity and equality in the discharge of their functions.
It was impressed upon the officers to adhere to the basic human values and conduct in accordance with the uncodified and codified rules of ethics, standards and norms. He also examplified the principles of natural justice and conduct of the officers vis-a-vis exercise of their judicial and quasi-judicial functions in relation to provisions of various laws. The participating officers raised many queries which were replied and clarified by the Resource person.
The 2nd Session was taken by Pawan Dev Kotwal, Director, State Judicial Academy in which participating officers interacted freely and asked many questions which were discussed and answered by the Director.
