Ensure no violation of prohibition on use of plastic bags: DB

JAMMU, Nov 28: Division Bench of the State High Court comprising Chief Justice Gita Mittal and Justice Sanjeev Kumar has directed respondents to take strict measures to ensure that there is no violation of the prohibition for use of plastic bags in the State.
“In pursuance of the order dated 24th October 2018, we are informed by S F Qadiri, Amicus Curiae that the respondents have identified eleven gardens in the status report dated 20th October 2018, however, on a physical inspection, he was able to find only six gardens in existence”, the DB observed, adding “Amicus Curiae has submitted that three of the gardens namely Mali Training School Rajbagh, Flower Mandi Rajbagh and New Kashmir Park appear to be nonexistent”.
Accordingly, DB directed the Director of the Department of Floriculture to assign a senior officer, who shall accompany Amicus Curiae for inspection of these three gardens.
Division Bench observed, “this report also makes a reference to the littering on the public parks. This again underlines the imperative necessity of framing By-Laws under the Environment Protection Act and the Rules of 2016 which would provide fines for littering of the public spaces”, adding “the report again underlines the requirement for the State to strictly enforce the prohibition regarding the plastics in the State and to prevent its very entry”.
“We are informed that the State does not have any manufacturing plant for plastic bags within the State and plastic bags are brought into the State only on account of interstate transportation”, the DB said observed and directed respondents to take strict measures to ensure that there is no violation of the prohibition for use of plastic bags in the State.
“The action plan in this regard as well as action taken report shall be filed within six weeks from today. The respondents shall continue to make every effort to improve the available public parks and gardens”, the DB said.
