JAMMU, Aug 8: The then Deputy Commissioner Budgam, other officials and a beneficiary have been booked in a case of illegal appointment by Vigilance Organization Kashmir (VOK).
According to VOK sources, the organization has registered a case under Prevention of Corruption Act on outcome of a verification conducted by it into the allegations of illegal appointment of a person namely Mohammad Iqbal Wani son of Rehim Wani, resident of Lalpora, Beerwah Budgam, as Junior Assistant against an available post in Education Department in the Pay Scale of 950-1500 under SRO 43.
During verification conducted by VOK, it came to fore that the then DC Budgam has illegally issued appointment order under SRO No 43 in favour of Mohammad Iqbal Wani. The verification conducted established that the reference to SRO No 43 is illegal, as compassionate appointment of a person can be done only in case of a person, who is a family member of deceased person as defined under Rule (2) of SRO 43. However, the Rule does not cover the beneficiary appointee Mohammad Iqbal Wani, who had sustained injuries and the appointment as such is illegal.
“By acting in this manner, erstwhile DC Budgam and other concerned officials abused their official position and illegally conferred undue pecuniary advantage upon the accused beneficiary, in connivance with the latter”, sources said, adding, accordingly a case FIR No 22/2017 under section 5(1)(d) r/w 5(2) J&K PC Act, Svt, 2006 and 120-B RPC in police station VOK was registered against the then DC Budgam, the beneficiary Mohammad Iqbal Wani and others, and investigation of the case taken up.
