Fast Track Court convicts 3 in gang-rape of tourist

JAMMU, Jan 30: The Fast Track Court constituted for speedy trial of crime against women today convicted three accused in gang-rape of a tourist.
According to the police case, on May 16, 2006 prosecutrix, a resident of Bhopal, along with her son travelled from Kashmir to Jammu and reached Jammu Railway Station for onward journey to her native State. After keeping luggage in the waiting room, she along with her son left the Railway Station for market to take meals.
At taxi stand, accused persons namely Subash Chander, Devinder Kumar and Randhir Singh seduced and lured her to sit in their Indica car with the promise to provide her good food in a hotel. However, sensing trouble, the woman and her son raised who and cry but accused threatened to eliminate the woman and her son. The fear stricken woman was then taken to an isolated place where the accused persons raped her. After being released by the accused, the woman lodged a complaint with the police and after completion of investigation challan was presented in the court of law.
After hearing APP GS Charak appearing for the State whereas Advocate B B Kotwal appearing for the accused persons, Presiding Officer Fast Track Court Sanjeev Gupta observed, “the Court is of the opinion that prosecution has succeeded in proving that prosecutrix after her abduction by the accused was subjected to forcible gang rape in the presence of her child who at the relevant time was about 8 years of age”.
“The evidence of prosecutrix remained unshaken and she has identified the accused persons in the court in her deposition. The evidence on record reveals that there was simultaneously meeting of mind of accused persons to commit crime of rape so requirement of Section 376 (2) (g) is established”, the Presiding Officer said.
Accordingly, all the accused were convicted for commission of offence under Section 366/376 (2) (g) RPC read with Section 34 RPC. The Court has fixed January 31, 2013 for arguments of counsels on quantum of sentence.
