Father-son acquitted in rape case

JAMMU, June 28: Principal Sessions Judge Udhampur, A K Koul today acquitted father-son namely Umar Din and Mohd Imran in alleged rape case as all the facts were found to be in disarray.
According to the police case, in June 2010 the prosecutrix was caught hold by Mohd Imran in a field and raped her. When the parents of girl came to know about the incident they lodged protest with the parents of accused. However, Umar Din, father of the accused, wanted to hush up the matter and offered a sum of Rs 50, 000 as compensation to the prosecutrix on her promise that she would not pursue the matter before the police.
Later, Umar Din back tracked and did not pay any money to the prosecutrix. Instead he lodged a cross case against the prosecutrix and her parents. However, during investigation Mohd Imran found guilty of committing offences under Section 376/506 RPC and his father was found involved in commission of offence under Section 195-A CrPC.
After hearing Advocate KB Gupta for the State whereas Public Prosecutor Navneet Gupta for the State, Principal Sessions Judge observed, “there is no escape from the conclusion that the prosecution case does not stand on a firm footing and all the facts seem to be in disarray. A doubt free nexus between the accused and the guilt is altogether missing”.
“The statement of prosecutrix deserves out-right rejection in view of serious infirmities in it. The Court is left with no option but to conclude that the case is a failure”, the Court. Accordingly, the case was dismissed and the accused were acquitted of the charges framed against them.
