File status report in gang rape case: HC to SHO Majalta

JAMMU, Nov 21: High Court today directed SHO of Majalta Police Station to file status report in the gang rape of a Bakerwal girl.
The prosecutrix belonging to Bakerwal tribe and permanently settled in village Charawa near Mansar Lake was subjected to gang rape by Mohd Anwar and Haroon in the month of October this year.
After committing the crime, the accused warned the prosecutrix and her family that if they dared to disclose the incident to anyone they would be eliminated and if they follow their instructions they would be monetarily compensated.
However, the prosecutrix and her family members approached Police Station Majalta with a written complaint and FIR No.55/2014 dated 06-10-2014 under Section 376/342 RPC was registered against the respondents.
On 09-10-2014 the statement of prosecutrix was recorded before JMIC Majalta. In the statements, the petitioners narrated their tale of woes and substantiated the contents of the FIR.
“More than 40 days have expired from the date of registration of FIR No.55/2014 but there is no headway in the investigation and the accused are roaming freely in the society and are extending open threats to the petitioners and their family members”, said Advocates S S Ahmad and Sheikh Najeeb Ashraf appearing for the petitioners.
“The police is investigating the matter casually and has so far not taken serious steps to arrest the accused in such a heinous offence. The police cannot be allowed to act as a mute spectator and is under a legal/statutory obligation to investigate the matter fairly uninfluenced by the political patronage enjoyed by respondents”, they further said.
After hearing the counsels for the petitioners, Justice Mohammad Yaqoob Mir issued notice and directed IO of the case to file latest status report of the case.
