JAMMU, June 15: Central Administrative Tribunal (CAT) Jammu Bench has directed the Government to fill up 329 posts of the Stock Assistant while vacating the stay granted by the previous bench of court on 17.08.2021.
The order in this regard has been passed by the Judicial Member Rajinder Singh Dogra directing the Services Selection Board (SSB) to initiate the process of recommending the names of the 329 candidates to the indenting department for the appointment against the advertisement dated 17.07.2021.
The CAT while dismissing the petition observed that 329 people cannot be made to suffer unnecessarily for the frivolous litigation filed by only 37 applicants, and it is not appropriate to keep 329 posts on hold for 37 applicants only.
The fact of the case is that these 37 applicants have acquired one year training for Stock Assistant at the cost of Government exchequer and when the posts were advertised in July, 2021 there was no provision for giving weightage to the diploma holders for Stock Assistant but they demanded weightage for the diploma they have acquired. So, the court stayed the proceedings and thereafter reply was filed by the respondents submitting therein that there was no such provision in the R&P Rules for granting weightage to the candidates who possess one year diploma in Stock Assistant, therefore they were not entitled for these posts.
The court observed that this training was imparted by the Government to the unemployed youth with the purpose that they could earn their livelihood and become self-employed, but they cannot claim appointment as a matter of right to be appointed against these posts as there exists no such provision with regard to weightage for the diploma holders in the R&P Rules and nor in the advertisement.
“The applicants therefore have no legal right that they should be given weightage for the diploma”, the CAT said while rejecting their claim and directed the respondent-department to go ahead with the recruitment process by filling up of 329 posts which were kept on hold till date.
