Final seniority list of KAS challenged

JAMMU, Apr 12: State High Court today directed the State not to initiate process of making any further promotions on the basis of final seniority list of KAS till further orders.
This direction was passed by Justice Tashi Rabstan in a bunch of petitions challenging the final seniority list of officers of KAS.
The grievances of petitioners were that on April 21, 2010 Government issued tentative seniority list of KAS and when the objections were filed a committee was constituted to make suitable recommendations for issuing final seniority list.
However, the committee wrongly made recommendations which were contrary to the statutory provisions of Rule 15(4) of Rules of 2008, the petitioners submitted, adding official respondents have not conducted any exercise for appointing/promoting them in the time-scale in 2004, 2005, 2006 and 2007 in terms of J&K Administrative Service Rules, 1979 despite of the fact that they were eligible and vacancies were available in their respective feeding service at the relevant point of time.
They further submitted that official respondents have wrongly interpreted and applied judgment of Supreme Court in case titled State of J&K Vs Javed Iqbal Balwan and State of J&K Vs Suraj Parkash. With these submissions, they prayed that the impugned final seniority list should be quashed.
After hearing battery of lawyers, Justice Tashi Rabstan directed respondents not to initiate process of making any further promotion on the basis of final seniority list till further orders.
