The terms and condition of the agreement were neither made to public or not to the flat buyers, but it was informed to the buyers by the sale manager that all the powers were vested to ABL starting from advertisement, booking, construction and delivering of possession including registration of the flats, they said, adding that the price of the flats were also fixed by ABL.
“The buyers booked the flats after paying the fixed price against each flat—2 BHK and 3-BHK respectively. It was promised that flats will be completed within specified period”, they added.
After collecting Rs 20 to 25 crore from buyers, the company instead of completing the project had utilized the money in increasing their business elsewhere and project was delayed for 7 to 8 years leaving the buyers in waiting till today, they said, adding that although the construction of structure is now complete but deficiencies amounting Rs 3 crore are still pending and possession so promised has not been given to respective buyers.
