Fresh guidelines for reservation to disabled

JAMMU, Nov 16: The Government today issued fresh guidelines for implementation of reservation to persons with benchmark disabilities as their reservation had earlier been enhanced horizontally from 3 per cent to 4 percent in terms of the Rights of Persons with Disabilities Act.
“The General Administ-ration Department and the Department of Law, Justice and Parliamentary Affairs had on October 13, 2021 asked the Social Welfare Department to carry out necessary amendments in the guidelines for implementation of reservations to persons with benchmark disabilities due to increase their reservations,” a Government order said.
The revised guidelines were necessitated as the Government had last year amended the Jammu and Kashmir Reservation Rules and enhanced the horizontal reservation from 3 per cent to 4 percent for Physically Challenged Persons in terms of the Rights of Persons with Disabilities Act.
The revised reservations include one percent each for blindness or low vision, deaf and hard of hearing, loco-motor disability including Cerebral Palsy, Leprosy Cured, Dwarfism, acid attack victims and muscular dystrophy and autism, intellectual disability, specific learning disability and mental illness.
“Although the recruitment of physically challenged persons would be only against posts identified as suitable for them, while computing the vacancies to which the reservation would apply, the total number of vacancies occurring in the said Gazetted and Non-Gazetted cadre would be taken into account i.e. 4 percent for computing on the basis of vacancies occurring in both identified and non-indentified posts,” the Government order said.
It added that in the event of reservations not being utilized in the same block in which it fell due, it shall be carried forward to next block or blocks as the case may be in the same year.
“In such exigencies where the reservation could not be utilized in any of the blocks during the year, the same shall be carried forward in the subsequent three recruitment years at the end of which the reservation shall be deemed to have lapsed,” the order said.
It said only Junior Assistant/ clerks, Junior Stenographers and Laboratory Assistance in an organization have been identified to be fit to be manned by the physically challenged persons candidates whereas the other categories like drivers, Research Assistance etc are not identified.
“Reservation for SC/ST/OSC may be called vertical reservation while the reservation for physically challenged persons as horizontal reservation. Horizontal reservations cut across vertical reservation (in what is called interlocking reservation) and persons selected against the physically challenged persons quota have to be placed in the appropriate category if he/she belongs to SC category, they will be placed in that quota and will utilize an SC Roster point.
“Similarly, is they belong to General category, they will be placed in that category and will utilize a general category roster point. If he/she belongs to OSC or ST category, they will utilize an OSC or a ST roister point,” the order read.
