KATHUA, Dec 8: Strongly opposing reservation in promotions, Joint Action Committee of All J&K General Category Sabhas and Biradaris of district unit Kathua has appealed the State Government to strictly implement the order of the Division Bench of the State High Court with regard to abolition of reservation in promotion of reserved category employees.
Talking to media-persons, the JAC members declared that this fight against injustice and `reverse discrimination’ is not targeted against any community, caste or creed. Any attempt by anyone to politicize this fight against injustice as an inter-community clash will be condemned in severest possible manner. The general category members are demanding implementation of High Court orders because reservation in promotions is ‘Reverse Discrim-ination’ coupled with ‘Adminis-trative inefficiency’ which is against national interest. It disturbs the balance between equality and positive discrimination and obliterates the constitutional limitations namely, ceiling limit of 50 % (quantitative limitation) and the concept of creamy layer (qualitative limitation) and hence dents upon the basic structure of the Constitution.
The JAC members pointed out that Dr Ambedkar had always dreamt of an egalitarian and just society which could not be achieved by affecting the basic structure of the Constitution. Under Article 335, the State has to keep in mind the over all efficiency of the Administration. Reservation in promotions impinges upon Administrative efficiency.
Reservation in promotions is `reservation within reservation’ which affects the equality code indicated in Article 14, 15 and 16 of the Constitution.
The Committee also sought support from intellectuals, social workers, other activists and people from every strata of the society in national interest. The JAC further reinforces its commitment for the welfare of the poor, needy and backward and the down-trodden and exhorts the well-off and creamy layer members within the backward/ reserved categories to do the needful.
