Govt duty to implement PMBJAPK scheme: HC

Srinagar, Dec 6: High Court today closed the PIL seeking implementation of Pradhan Mantri Bhartiya Jan Aushadhi Pariyajna Kendra (Centrally sponsored scheme) with the saying that it is the duty of Government to get it implemented and not the court of law.
The PIL was filed by one Muzaffar Hussain Bhat seeking the implementation of Pradhan Mantri Bhartiya Jan Aushadhi Pariyajna Kendra in the erstwhile State of J&K. He was further seeking directions from the court that the authorities be directed for setting up and reserving the spaces with in the Government Hospitals at all levels in the J&K.
The Division Bench of Justice Ali Mohammad Magrey and Justice D S Thakur while closing the PIL said, the reliefs sought for by the petitioner, on the face of it, is exclusively the domain of the executive and the court of law has no role to play. “The petitioner can approach the concerned authorities with all the material supporting his claim for seeking appropriate relief”, court added.
It is alleged in the petition the J&K Government has formulated the policy in total contravention to the scheme of Centre on Pradhan Mantri Bhartiya Jan Aushadhi Pariyojna.
