Govt’s fresh guidelines on quota appointments

JAMMU, Sept 24: In a major decision aimed at ensuring the persons availing benefits of appointments in Government jobs and admissions in professional institutions against reserved category posts for Line of Actual Control (LAC) and backward areas rendered at least seven years of services in their areas, the General Administration Department (GAD) headed by Chief Minister Omar Abdullah has issued fresh set of guidelines to the Administrative Secretaries and the Heads of Departments (HoDs) to identify vacancies in these areas and strictly implement the Government order on postings.
‘‘The employees, who didn’t join the place of the postings in the backward areas and LAC they belonged and on the basis of which they had been appointed in the jobs and professional courses, would be liable for termination from services’’, official sources told the Excelsior.
The Government had amended the Jammu and Kashmir Reservation Act, 2004, a couple of years back in which it had been made mandatory for any person appointed against any available vacancy on the basis of being a resident of backward or an area adjoining the Line of Actual Control to serve in such areas for a period of not less than seven years.
In case the post against which the person had been appointed was not available in backward area or the LAC, the person was to be appointed in the nearest adjacent area. If the person after being appointed on the basis of reservation declined to serve in the reserve area, he was liable for termination from the service after being given an opportunity of hearing.
Sources said during a recent Cabinet meeting it was brought to the notice of Chief Minister Omar Abdullah that persons appointed on the basis of reservation earmarked for backward area and areas adjoining the LAC were not serving in these areas notwithstanding the fact that their appointment had been made on the basis of such reservation.
The Chief Minister had directed that the General Administration Department, which was held by him, would issue the guidelines once again for operationalising the statutory provisions of the Act.
Accordingly, sources said, the GAD , has asked all Departments to identify the posts located in the backward areas/areas adjoining the LAC.
‘‘All departments would verify as to whether such employees, who have been appointed against the quota vacancies reserved for persons belonging to backward areas/areas adjoining the LAC, have served a period of seven years in those areas or, in case of non availability of vacancy, the nearest adjacent area’’, sources said.
They added that in case of any of such employees, who have not served for seven years in the backward areas/areas adjoining the Line of Actual Control, they should be immediately posted in such areas.
‘‘In case, the posts were not available in the areas (backward or the LAC), they shall be posted in the nearest adjacent backward or LAC area as the case may be’’, they said.
The Government has directed that all Administrative Secretaries will personally monitor and ensure that these provisions were strictly adhered for both Gazetted and non-Gazetted State cadre posts.
‘‘Similarly, the Heads of Departments will personally monitor and ensure that these provisions were strictly implement for non-Gazetted divisional and district cadre posts’’, sources said.
The Government has directed the Administrative Secretaries to strictly comply with the fresh set of guidelines issued by the Government. It has asked the Departments that copies of the orders of transfer/posting should be invariably endorsed to the General Administration Department and the Social Welfare Department.
Sources made it clear that if the employees didn’t join the place of posting, they had been assigned on the basis of their reservation from backward areas or areas falling close to the Line of Actual Control, they would be liable for termination from the services.
