Haq for effective follow-up of cases, performance appraisal of Law Officers

Excelsior Correspondent
SRINAGAR, May 18: Minister for Law and Justice and Rural Development Abdul Haq today expressed serious concern over the frequent personal appearance of Administrative Secretaries and other senior State Government officials in the courts and called for rigorous follow-up of the cases in the respective departments.
While chairing a high level meeting of Administrative Secretaries of various departments to review the status of cases, the Minister asked all the Secretaries to regularly monitor the progress of the pending cases of their respective departments and if needed consult the Law Department for guidance.
The meeting was also attended by Advocate General, DC Raina.
Abdul Haq said, “stay orders in respect of developmental projects are required to be vacated immediately and for that the Government needs to follow the cases effectively to satisfy the courts”. He directed officials to follow the court directions in letter and spirit and file timely responses and objections before the court to avoid adverse orders.
The Minister also asked the administrative departments to give their inputs about the performance of concerned Law Officers. He further directed the officials to file appeals on time and asked them to make every possible effort to avoid unnecessary litigation
It is pertinent to mention here that EXCELSIOR in its edition dated April 29, 2016 had highlighted that State Government has failed to learn lesson from frequent orders of the High Court seeking personal appearances of the senior bureaucrats.
Besides lack of coordination and delay in taking decisions on the orders of the High Court, it was also brought to the fore that the concerned departments don’t receive the copies of the orders of the High Court from the concerned Law Officer/Government Advocate on time and this leads to delay in filing of timely response.
