HC castigates Govt for delay in appointment of chairman FFC

SRINAGAR, July 14:  High Court today castigated Government for not appointing chairman of Fee Fixation Committee (FFC) and sought personal appearance of Commissioner Secretary Education Department to explain his position why he should not be punished for not implementing court orders.
“The first respondent (Commissioner Secretary Education) is directed to be present in person in the court on next date of hearing to State the reason as to why he be not punished for not complying with the directions issued by this court”, directed the Division Bench of Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magrey.
Court pulled up the state counsel Shabir Naik (AAG) for not appointing the Chairman for the Fee Fixation Committee as directed in June 1 order and observed:  “you are polluting the management”. However advocate Naik could not give a reasonable reply to the court and court further observed to him “face the music” and “bring the Commissioner Secretary here on next date”.
State had moved the application for extension of time for appointing the chairman for the (FFC) which the court out rightly rejected as there was no reason given for extension of time.
Court also warned the President Unaided Private School Coordination Committee G N War who was present in the court for misquoting and falsifying the court order in general public. His counsel stated before the court that his client (War) has not received any notice regarding contempt proceedings as such he may be granted some time for filing his response which the court granted.
Court has been apprised by the state counsel that circular with regard to waiving off fee for the month of September and October 2014 has been issued by the Education Department.
Court had issued contempt notice to president Unaided Private School Coordination Committee G N War as it has been brought to the notice of the court that the president is misquoting the judgment of the court in general public and making press statements in this regard asking the parents and students to deposit the fee for the two months as it is direction of the court.
The court passed the judgment and observations while hearing contempt petition of parents body who had sought action against the education authorities and president Unaided Private School Coordination Committee G N War who had misquoted and misrepresented the judgment of court and asked the parents of the students to pay fee for the month of September and October last year which court had waived off due to the devastating floods.
