HC closes contempt proceedings against CEO Gulmarg, DC

Srinagar, July 1 : High Court has closed the contempt proceedings against the Chief Executive Officer (CEO) Gulmarg and Deputy Commissioner Baramulla filed by the Army alleging that they are not being allowed to lift construction material of necessary repairs and renovation of High Altitude Warfare School (HAWS) in Gulmarg tourist resort.
The contempt petition has been disposed of with the liberty to Army to move an appropriate proceedings in the PIL regarding conservation and protection of resort in case it is found that the GDA is not taking proper action pursuant to any court direction. “Having gone through the averments made in the petition, we are not satisfied that there is any wilful or deliberate disobedience of any order”, Division Bench of Chief Justice Pankaj Mithal and Justice Sanjay Dhar said.
The CEO GDA and Deputy Commissioner Baramulla responded to the contentions raised by the petitioner-Army in contempt petition within and denied the contentions as raised in the contempt petition.
The contempt petition was filed on the ground that despite court orders the authorities are not permitting the Army to take the construction material on the sight as such are violating the court directions as already passed in this regard. High Court has already allowed the Army to make necessary repairs and renovations to the structures of High Altitude Warfare School in Gulmarg tourist resort.
Court while granting the relief to the extent of renovations and repairs of the school had made it clear that in case the applicant(Army) deviate from the information which has been furnished to BOCA, no equity shall flow in favour of the applicant and the applicant would have to abide by any orders which may be necessitated.
