HC closes PIL on NH1, says purpose achieved

Srinagar, Dec 30 : High Court today closed the PIL with regard to progress of construction of Qazigund-Srinagar National Highway by recording that its purpose has been achieved.
The dispute raised in the instant PIL was in respect of construction of Qazigund-Srinagar National Highway and widening of Pantha Chowk Raod. The status report filed by the respondents reveal that the construction work has been completed and it has been handed over to National Highway Authority of India.
The division bench of Justice Sanjeev Kumar and Justice M A Chowdhary after going through the status report and also having regard to the directions issued by the Court from time to time, was satisfied that the purpose, for which, the present PIL was filed, has been accomplished.
Court said there remains nothing in this PIL to proceed further. “The proceedings in this PIL are, thus, closed leaving it open to the petitioner to make a specific grievance, if any, they have in respect of construction of any particular road in accordance with law”, Court directed.
Court previously had directed the then Chief Secretary of Jammu and Kashmir to convene a meeting of the Commissioners /Secretaries to Government, Revenue Department; Power Development Department; and Forest Department and ascertain the difficulties, concerning the Government of Jammu and Kashmir, being faced by the National Highways Authority of India in the competition of the entire project, as detailed out by them in their status report/ response and issue all possible directions to the concerned authorities for their removal at the earliest.
