JAMMU, Dec 30: State High Court today came to the rescue of two disabled candidates, who had applied for appointment to the posts advertised under Prime Minister’s Special Package for Kashmiri migrants.
The Relief and Rehabilitation Commissioner (M) Jammu pursuant to SRO-412 dated December 30, 2009 issued advertisement notice inviting applications from Kashmiri migrants for filling up of 111 District Cadre posts of Lab Bearers and Class IV posts available in various departments.
The petitioners possessing the requisite qualification offered their candidature under the Physically Handicapped Category. However, they didn’t figure in the list of shortlisted candidates. When they approached the Relief and Rehabilitation Commissioner to ascertain the reasons for their exclusion from the list they were told that their candidature was not considered under the Physically Challenged Category.
Aggrieved over this, the petitioners knocked the doors of the High Court and Justice Ali Mohammad Magrey, after hearing the counsels for both the sides, issued directions to the respondents to consider the petitioners for interview and then appointment against the posts for which they have offered their candidature under the Physically Challenged Category.
“It would be in the interest of the justice not to quash the advertisement notice as the same was issued way back in July 2012 and interviews have been conducted only this year”, Justice Magrey said, adding “the respondents are, however, directed to conduct the interview of the petitioners under the Physically Challenged Category if they possess the disability certificates and consider them for appointment against the posts in accordance with the law on the subject”.
