Srinagar, May 27: High Court today rejected the bail applications of two forest officers of the State who allegedly purchased question papers of Jammu and Kashmir Board of Professional Entrance Examination (BOPEE) Common Entrance Test (CET)-2012 to get their sons admitted in MBBS course.
A Division Bench of the High Court comprising Justice Muhammad Yaqoob Mir and Justice Hasnain Massodi dismissed bail application of forest officers, Muhammad Amin Mir and Altaf Hussain Shah.
The court observed: “It is true that the personal liberty guaranteed under Article 21 of the Constitution of India is of great importance. Incarceration is permissible only after accused is convicted and sentenced but grant of bail to safeguard personal liberty is controlled by reasonable exception.”
The court said the allegations in the supplementary charge sheet filed by the Crime Branch reveal that the accused have purchased the question papers of CET-2012 illegally and getting MBBS admissions of their sons fraudulently by dislodging the candidates of genuine merit.
“It is quite disheartening to notice that allegedly fathers of the students have stooped low so as to purchase papers and ensure position of their sons in the merit list of the students for admission to MBBS course,” the Division Bench said.
“The commission of the offence is serious, heinous and exposure of the fraud has rattled the confidence not only of the aspiring candidates in the function of the Board but also of the general public who have espoused trust in such institutions,” the court observed.
