SRINAGAR, Apr 16: The High Court has directed the Public Services Commission (PSC) for advertising the post of Lecturer in medical stream under Schedule Tribe category and for allowing the petitioner to participate in the selection process after fulfilling the criteria.
Justice MK Hanjura disposed off the writ petition filed by one Dr Shafiqa Bano seeking that the PSC be directed to advertise the post of lecturer in discipline of Gynaecology and Obstetrics for Schedule Tribe category.
“…the petition is disposed of with a direction that the respondents shall advertise the post of the Lecturer in the discipline of Gynaecology and Obstetrics under the Schedule Tribe Category”, Justice Hanjura directed.
Court also directed the PSC to allow and participate the petitioner in the selection process in case she fulfils the eligibility criteria laid down for the post.
Petitioner after qualifying Post-Graduation Course in the field of Gynaecology and Obstetrics from the University of Kashmir was appointed as Registrar, Government Medical College, Srinagar where after she has been holding the post of a B-Grade Gynecologist.
Court said, the petitioner, as it appears has completely misunderstood and misconstrued the contents of the order passed by Division Bench which, Court said, does not in any way come to the aid and assistance of the petitioner.
“Although the order stated that the counsel for the petitioner wants that the respondents be expressly directed to appoint the petitioner under the ST category, yet the Court has held that since no such post is available under the ST category, therefore, no such direction can be issued”, court mentioned.
