HC directive on DySPs’ Sr. list

JAMMU, Oct 4: In a contempt petition filed by Incharge Deputy Superintendents of Police, High Court has directed AAG Raman Sharma appearing for Principal Secretary Home and Director General of Police to file compliance report with regard to the judgment dated October 26, 2017 whereby they were directed to complete the process of finalizing the seniority of DySPs within a period of three months.
High Court had further directed that in case the needful was not done within the period of three months the Home Department and DGP shall not make any promotion/Incharge arrangement /placement to the higher posts— Selection Grade DySPs and SPs if there is no legal impediment.
After considering the submissions of Advocate Sheikh Shakeel Ahmed with Advocates Supriya Chouhan and Mohd Zulkernain Chowdhary appearing for Incharge DySPs in the contempt petition, Justice Tashi Rabstan further directed AAG Raman Sharma to place on record all the orders issued by the Home Department pursuant to the decision of State Administrative Council.
The AAG was further directed that SAC’s decision No.25/21/2019 dated September 13, 2019 be also produced along with the compliance report. “In case the compliance report is not filed then adverse orders shall follow”, Justice Rabstan made it clear.
Earlier, Advocate S S Ahmed submitted that Government Order No.995-Home of 2019 dated 28-09-2019 has been issued by Principal Secretary Home Department whereby pursuant to the approval of State Administrative Council the sanction has been accorded to the regularization /promotion of the I/C DySPs as DySPs in the Pay Matrix 9300-34800 with regard to 153 officers and the names of only 4 petitioners figure in the order.
“The process of regularization is not the full compliance of the judgment passed by the High Court as the direction was to finalize the seniority of all the DySPs”, he further submitted, adding “Home Department has issued Govt Orders No.991 to 995 dated September 28, 2019 in piece meals after ignoring the genuine claims of Incharge DySPs whose number is around 350 to 400 and many officers superannuated awaiting their regularization and also fixation of their seniority”.
Stating that grave injustice has been done with the Incharge DySPs who rendered their services in most difficult times in the State of J&K, Advocate Ahmed submitted, “Home Department has miserably failed to fix their seniority as a result of which most of the petitioners have retired against the substantive posts of Inspectors as their Incharge promotions /arrangements never came to be regularized due to lackadaisical approach of the Home Department”.
