SRINAGAR, Sept 17: High Court today directed the Government to file fresh status report within a week over the Hot and Wet Mix plant operating in Handwara area of district Kupwara.
Pulling up the SSP Handwara and Chairman Pollution Control Board for filing a “dissatisfying” report, a Division Bench of the HC comprising Chief Justice M M Kumar and Justice Dhiraj Singh Thakur directed the SSP Handwara and Chairman Pollution Control Board to file report giving complete details about the plant.
“We are prima facie of the view that the compliance reports are far from satisfactory,” the Bench observed.
Pointing out in his report the plants are operating without any legal document, the SSP Handwara submitted the plant has been seized.
The Bench observed, “what are the legal documents required and those lacking have not been specified” after the SSP submitted his report which didn’t mention required documents for the operation of the plant.
To the compliance report submitted by PCB Chairman, the court observed the permissible limits of suspending particulate matter have not been given, only the result is shown. And samples were taken when the plant was not in operation, it further observed.
The Bench was hearing a PIL seeking closure of the Hot and Wet Mix plant operating around Mavar stream, a source of drinking water, in Handwara and removal of encroachments on Kacharai land around it.
