JAMMU, June 1: As several petitions challenging the jurisdiction of State Accountability Commission (SAC) were pending in the High Court for more than five years, Justice J P Singh today directed Registrar Judicial to obtain orders of Acting Chief Justice for listing all these cases in the next week so that these cases are kept on board until their final conclusion.
During the course of consideration of petition filed by Minister of State for Cooperatives, Dr Manohar Lal Sharma challenging the SAC order whereby regular inquiry has been initiated against him, it transpired that number of petitions were sub-judice in the High Court where the jurisdiction of SAC to initiate suo-moto proceedings was questioned.
“These petitions are pending for more than 5 years and non-consideration of all these cases for such a long period has rendered the SAC virtually non-functional”, Justice J P Singh said, adding “the public interest therefore demands early consideration and disposal of the cases to determine the issues raised therein”.
With these observations, Justice J P Singh directed Registrar Judicial to obtain orders of Acting Chief Justice for listing of all these cases in the next week so that these cases are kept on Board until their final conclusion.
Earlier, after hearing Senior Advocate B S Salathia with Advocates S K Shukla and Asheesh Sharma for Dr Manohar Lal Sharma, the High Court stayed the proceedings against the petitioner before SAC till next date with the direction to list this petition on June 4, 2012.
