JAMMU, Apr 1: In a petition seeking quashment of Guest Control Order, Acting Chief Justice Ramalingam Sudhakar today directed the Food, Civil Supplies and Consumer Affairs Department not to take coercive steps against the persons who are conducting the functions and the marriage halls.
During the course of hearing, Senior Advocate Sunil Sethi with Advocate Mohsin Bhat submitted that the petitioners are residents of the State of Jammu and Kashmir and for marriage functions of their respective families they have booked different banquet halls mainly in Jammu by giving them the charges commensurate to the gathering expected by them in such functions.
“The petitioners have also booked various hotels and guest houses for staying of their guests/invitees who will attend the marriage functions on different dates by spending huge amount. Even advances have been paid for procuring various items to be distributed amongst the invitees both while distributing invitation cards as also for catering them while their stay at Jammu”, they said, adding “the banquet halls according to the need and requirement of the petitioners to make their marriage functions memorable have already engaged service of various professionals by spending huge money.
They submitted that the Guest Control Order was unreasonable and unjustifiable and unconstitutional restrictions have been imposed with respect to number of invitees and use of essential commodities in various functions.
After hearing counsels for the petitioners, High Court directed the Food, Civil Supplies and Consumer Affairs Department not to take coercive steps against the persons who are conducting the functions and the marriage halls.
