HC directives on registration of Dental Hygienists, Mechanics

JAMMU, Sept 15: State High Court today directed respondents to issue a notification inviting applications from the eligible persons for their registration on the Register of Dental Hygienists and Dental Mechanics under the J&K State Dental Council within a period of three weeks from the date of receipt of a certified copy of the order.
After hearing Senior Advocate Sunil Sethi with Advocate Parimoksh Seth, Justice Alok Aradhe further directed that on issuance of such a notification, the petitioners as well as all the eligible persons will be entitled to submit the applications for their registration on the rolls of the J&K State Dental Council and on receipt of applications from the eligible candidates including the petitioners, the competent authority shall scrutinize the applications for registration and shall take a decision in this regard within a period of two weeks from the last date of receipt of the applications.
High Court further said, “the petitioners, who are Dental Hygienists, Dental Mechanics and Dental Assistants, shall carry out their activity, which is permissible under the Act and the Rules. After registration, the petitioners will be bound by the provisions of the Act and the Rules. Till the process of registration and the scrutiny of the applications submitted by the petitioners is undertaken by the Competent Authority of the J&K State Dental Council, no action shall be taken against the petitioners for sealing of the premises”.
“The premises of the petitioners, which have been sealed, shall be de-sealed by the J&K State Dental Council”, High Court said, adding “the J&K State Dental Council, if so advised, would be at liberty to take action against the petitioners in terms of the Section 49 of the Dentist Act”.
