HC directs CB not to use coercive measures for realization of tax from AAI

JAMMU, July 3: Jammu & Kashmir and Ladakh High Court has directed Cantonment Board (CB) not to use any coercive measures for realization of the Property Tax to the tune of Rs 12,81,69,357 from Airport Authority of India.
The order has been passed in a petition filed by Airport Authority of India through Advocate Inderjeet Gupta with Advocate Yatin Mahajan.
After hearing counsels for AAI, Justice Mohd Yousaf Wani issued notice to the respondents. Advocate Sumant Sudan appearing vice Vishal Sharma, DSGI accepted notice on behalf of the respondents, who have been directed to file objections by or on the next date of hearing.
High Court ordered for listing of petition on August 5, 2024 and in the meantime, subject to any vacation/modification upon the consideration of objections/arguments and till next date of hearing, the respondents were directed to revisit the orders dated 08.09.2023 and 07.06.2024 in the light of the averments made in the writ petition and are also directed to submit a consideration report by or on the next date of hearing, by which date, they shall not use any coercive measures for realization of the tax.
