HC directs CDPOs to continue holding posts

SRINAGAR, Feb 18: High Court directed for continuation on the post of Child Development Project Officers is in Social Welfare Department who are holding the said posts on In-charge basis.
Hearing the petition filed by 10 CDPOs who claim to be placed as Incharge on these posts, the court directed the Government that the present position of these officials qua holding of the posts of CDPOs, shall be continued till next date of hearing before the bench.
These officials are seeking regular promotion qua adherence to the draft recruitment rules, initiated by the Mission Director ICDS, in terms of the communication passed in 2017 and pending such promotion, they are seeking continuation on their posts.
Their counsel before the court submitted that the posts of CDPOs were created with reference to implementation of Integrated child Development Scheme and drawn the attention of the court to the decision of 1986 taken by the Ministry of Human Resources Development Department of Women and Child Development CD section, Government of India conveyed to all Secretaries of all States and UTs.
Court said the invitation of the decision demonstrates that all States and UT authorities are required to make recruitment to the post of CDPOs by framing the recruitment rules or to revise the existing one as to provide for filling up of 75% of the posts by promotion from female Supervisors of ICD projects and the remaining 25% posts by direct recruitment.
Court has been apprised that the Government is, in violation of the rules and the scheme, promoting Tehsil Social Welfare Officers and Superintendent Homes against the post of CDPOs.
Court recorded that prima facie it appears that there is no scope of promotion of Tehsil Social Welfare Officers or Superintendent Homes against the post of CDPOs and the only feeding cadre in tune with the scheme of the Government of India, is the post of Supervisors of ICDs projects.
