HC directs Comm Secy H&ME, Principal GMC to file affidavits

JAMMU, Sept 6: In a controversy regarding the granting and rejecting the applications forms for the year 2013-2014 for the post of Registrar/ Demonstrators in Govt Medical College Jammu, Justice Dhiraj Singh Thakur today directed Commissioner Secretary Health and Medical Education and Principal Government Medical College Jammu to file affidavits with details regarding the years put in by such applicants in the Health Department and whose names have been recommended.
After hearing Advocate Abhinav Sharma appearing for the petitioner and Senior AAG Gagan Basotra for the State, Justice Thakur observed, “the matter was heard at length on the last date of hearing. A stand has been taken by respondent that no objection in favour of the petitioners was withheld on the ground that the health services in the State were facing acute shortage of numbers particularly in peripheral areas of the State”.
“With a view to test this stand, it becomes necessary to have certain more information from Commissioner Secretary Health and Medical Education Department”, Justice Thakur said and directed that the Commissioner Secretary Health and Medical Education Department besides producing the record on the next date of hearing, specifically submit a supplementary affidavit giving details about the number of applications filed by the in-service Assistant Surgeons working in the Health Department to the Director Health Service, Jammu for forwarding their cases for the post of Registrar/ Demonstrator to the Principal Government Medical College, Jammu for the year 2013 and 2014 in all disciplines and  the number of applications withheld on ground of shortage of doctors in the Health Department.
“It will be clarified as to whether any speaking order was passed while withholding such application forms by the Commissioner Secretary and the details of those application forms recommended by the Director, Health Services, Jammu and approved by the Commissioner Secretary for the year 2013-14”, High Court said and directed that the supplementary affidavit should be sworn by the Commissioner/Secretary, Health and Medical Education Department.
Justice Thakur further directed that the Principal, Government Medical College, Jammu shall also swear an affidavit giving details with regard to all applicants, whose cases were forwarded for the year 2013-14 for the post of Registrar/Demonstrator in regard to Assistant Surgeons working in the Health Department not only in the discipline of Anatomy but in all the departments for which applications were invited in the year 2013-2014.
