Srinagar, Aug 5: High Court today directed the authorities to consider the request of the petitioner for providing security and protection in view of threat perception as claimed by him.
The petitioner Mohammad Ashraf Bhat through his counsel submitted before the court that he is an elected representative of Municipal Corporation of constituency Rathpora as also his wife is an elected representative of Municipal Corporation of constituency Palpora and both are living in a disturbed area.
It is added that the petitioner is living along with his wife in the area where number of militant related activities have been reported from time to time. Giving the reference of July 8 about the killing of political activist of BJP, petitioner submitted that he and his wife are continuously living in fear and there is imminent threat to their life and liberty due to which they are not able to live a normal life.
Bhat informed the court that he had approached the police authority for grant of protection and the Additional Director General of Police, Security Law and Order vide his communication on May 11 addressed to IGP Kashmir zone that in view of the threat perception, necessary security care of the petitioner be taken from district resources but till date nothing has been done.
Bhat placed on record a threatening letter of one of the banned militant organization to demonstrate that the threat perception to life and liberty of the petitioner and his family.
Justice Rajnesh Oswal keeping in view of facts and circumstances of the case said, it goes without saying that it is the duty of the Government to protect the life and liberty of its citizens.
Justice Oswal disposed of the petition of Bhat with the direction to the police authorities to consider the claim of the petitioner for grant of security or protection in view of application made by the petitioner after evaluating the threat perception to the petitioner within a period of four weeks. Court directed the petitioner to make available the copy of the order to the authorities.
