HC directs CS to implement recommendations on H1N1

Srinagar, May 1: Jammu and Kashmir High Court today directed the Chief Secretary to implement the recommendations of the court committee and the directions of the court passed from time to time with regard to measures taken to deal with the H1N1 in the State.
The Division Bench of High Court comprising Justice MH Attar and Justice Ali Mohammad Magrey passed the directions to CS and said the recommendations may result in ‘terrestrial exit’ of many human lives.
“The Chief Secretary of State shall ensure that the court directions issued from time to time are implemented without any further fail. It is made clear that failure to implement the recommendations of court committee may result in terrestrial exit of many human lives and amongst all the living organisms on this planet, human life is most precious, authorities have to protect the same”, court directed.
Court directed the Director SKIMS to inform the court as to what effective steps the Governing Body of SKIMS and Government has taken for implementation of the court committee recommendations and sought status report from the Director in this connection before next date.
Court also directed the said committee to prepare a complete concluding report so that the court be in a position to direct the concerned authorities for implementation of the same.
“The court committee shall prepare and file a comprehensive final report to enable the court to issue directions to the concerned authorities for implementation of the same and added that the directions are being issued in view of the mandate contained in Article 21 of Indian Constitution”, court directed.
Court earlier had directed formation of three member committee headed by Director SKIMS for suggesting measures to deal with H1N1 influenza.
Court directed Commissioner Secretary Health and Medical Education Department, who till date has not filed the status report in terms of previous order, to file the same before next date of hearing or appear in persons before the court.
Meanwhile, court has been informed that no patient with H1N1 is presently admitted in any of the hospital of the Valley and court appreciated the steps taken by the court committee in providing immediate relief to the patients who recently suffered H1N1 infection.
Court exempted the Director Health Service as he tendered explanation detailing therein the reasons which prevented him to attend the court committee meeting as he was directed by the court.
Court on last date of hearing had directed the Director Health Services Dr Saleemur Rehman to explain his position for not attending the court committee meeting.
