HC directs DC Jammu to file ATR or appear in person

Encroachment of 34 kanals State land, felling of green trees

JAMMU, July 26: High Court today directed the Deputy Commissioner Jammu to file Action Taken Report regarding removal of encroachments on 34 kanals State land in village Rakh Kharoon of Akhnoor tehsil within two weeks or appear in person on next date of hearing.
In terms of order dated December 28, 2018, the Deputy Commissioner Jammu was required to remove encroachment but non-filing of ATR was viewed seriously by Justice Tashi Rabstan when the matter came up for hearing today.
The issue of encroachment was highlighted in a writ petition filed by Satish Kumar Sharma, a resident of Rajpura Camp in Marh tehsil.
When the petition came up for hearing, Advocate Sheikh Shakeel Ahmed appearing for the petitioner submitted that on December 28, 2018 the court had directed Deputy Commissioner Jammu to submit a report with regard to action taken against Gopal Dass, son of Parkash Chand for felling the green trees standing over the State land and steps taken regarding his eviction from the land.
“Despite lapse of more than seven months the encroacher continues to be under the illegal occupation of the State land because of his clout in the corridors of power”, he further submitted.
At this stage, Senior AAG S S Nanda caused appearance on behalf of the State Government and submitted that one more opportunity be given to the Deputy Commissioner Jammu to file the ATR in terms of order dated December 28, 2018.
After considering the submissions of both the sides, Justice Tashi Rabstan directed Deputy Commissioner Jammu to file the status report in terms of order dated December 28, 2018 within a period of two weeks failing which he shall appear in person on the next date of hearing—August 28, 2019.
