HC directs DC to handover migrant land to its owner

Srinagar, July 6: High Court has directed the Deputy Commissioner Pulwama to hand over the possession of retrieved migrant land to its actual owner.
The petitioner-Vijay Kumar Bhat filed the petition demanding eviction of the unauthorized occupants from the land measuring 18 Marlas situated at Village Muran of District Pulwama and handover the same to him as his actual owner.
The Counsel for the petitioner submits that the Deputy Commissioner concerned be directed to handover the possession of land to him and he does not press any further relief in his plea.
Justice Rajnesh Oswal allowed the plea of petitioner-Bhat with the direction to the Deputy Commissioner Pulwama to handover the possession of land Kashmir to the petitioner provided there is no other legal impediment in the same.
The direction of handing over the possession of land in question followed after the revenue officials in response to the plea of the petitioner-Bhat informed the court that the land in question situated at Village Muran of District Pulawama was encroached by the encroachers and now the encroachers have been evicted from that land.
It was further stated by the officials of the Revenue Department that the land after its retrieval has been kept in the custody of Lambardar-Deh and Chowkidar-Illaka on Supurdnama.
