HC directs de-sealing of ETT colleges fulfilling requirements

Strict monitoring of colleges directed

SRINAGAR, Feb 4: In a major relief to the owners of the Elementary Teachers Training Colleges, High Court today directed the authorities to de-seal those colleges where they are satisfied with requirements in terms of latest amended rules.
Large numbers of these Colleges were sealed after massive irregularities were found few years back. Authorities concerned have been directed to de-seal those institutions after if they are satisfied with their fulfilling all requirements under and in-terms of latest amended rules.
A mafia in league with BOSE authorities is involved in this huge scandal and almost 480 colleges are operating in the entire State out of which 80 are in Kashmir Division and 320 colleges are in Jammu Division and two FIRs have been registered with regard to ETT scam as one in Kashmir and another in Jammu Division.
The High Court directed the Crime Branch to file the final report with regard to investigation carried in Elementary Teachers Training Colleges irregularities and further directed the Government to adhere strictly the amended rules for monitoring these colleges.
Hearing a much publicized Public Interest Litigation on irregularities and embezzlement by Elementary Teachers Training Colleges in the State, the Division Bench of Justice Ali Mohammad Magrey and Justice Sanjeev Kumar directed the investigating agency (CB) to submit its final report within two months in the FIRs registered in respect of irregularities and embezzlement by ETT Colleges in the entire State.
The DB while closing the PIL also directed the Government to adhere to the amended rules to monitor the proper functioning and running of these institutions without any malpractice.
As the Court had directed for necessary amendment of J&K School Education Rules 2010 in order to regulate the functioning of the these Colleges and prevent the corruption in the Education sector, the Government recently amended these rules by issuing SRO 292 which provides the procedure of recognition, monitoring, de-recognition, proper functioning, physical structure etc of these colleges for proper regulation and monitoring.
“Authorities shall consider the cases of institutes and ensure their inspection and requirements as laid down in the SRO aforementioned”, the DB said.
DB with regard to those ETTs which were running in contravention of rules and laws and sealed in view of registration of FIRs and in terms of various Court directions have been asked to approach the competent authorities as required under law.
In one of the reports, it is alleged that the candidates were lured and amounts, ranging from Rs 45,000 to Rs 80,000 were extracted from each one of them through touts for providing them degrees and certificates by these ETT colleges.
Court with regard to those officials who have been found involved in the scam directed that the action taken against them be taken to its logical end. Court with regard to fee structure in these colleges said any left-out grievances of fee structure shall be taken up with the appropriate authority.
Charge sheet with regard to FIR 36/2013 u/s 420,467,468,471,120-B/RPC r/w section 5(2) P/.C. Act P/S Crime Branch, Jammu has been produced before the Anti Corruption Court Jammu against various promoters of ETT institutes and against the then Director Academics BOSE Jammu Sheikh Bashir Ahmad and S S Salathia the then Joint Secretary ETT BOSE.
It may be mentioned here that he investigation is being carried out in the scam by Crime Branch Kashmir as well as by Crime Branch Jammu in connection of two FIRs registered one at CB Jammu and one at CB Kashmir and court is monitoring the investigation in which till date various revelations has come before the court about the bungling and irregularities in ETT Colleges throughout the State.
Enquiry report further alleged that these institutions were allowed and permitted to run the courses without issuance of NOC from the State Government, which is granted after inspection of these colleges.
As Court has already held that insatiable human greed has caused immense damage to our educational system as such the whole country will become nation of block heads, thus making its future dark.
In one of the communication sent by Chairman BOSE to IGP Crime because of the enquiry report of Joint Secretary BOSE and offence u/s 120-B (Criminal Conspiracy) has been added to the FIRs, which would mean that a conspiracy was allegedly hatched by the BOSE authorities with the owners of ETT institutes resulting into registering of FIR at Crime Branch Srinagar as well as Crime Branch Jammu.
Subsequently various college owners and some Board officials have been held guilty during the investigation conducted by Crime Branch and action as per law has been initiated against them and outcome of action taken is being submitted to the court from time to time.
