HC directs DGP to file compliance or appear in person

Out of turn promotion to SP

JAMMU, June 20: In a contempt petition filed by SP Mukesh Kakkar, High Court has directed the Director General of Police to file compliance or appear in person on next date of hearing.
SP Kakkar was seeking implementation of judgment passed by J&K High Court whereby respondents were directed to reconsider the petitioner for out-of-turn promotion/confirmation to the rank of DySP from a retrospective date with effect from 13.10.1998 with all consequential benefits and reckon his seniority accordingly.
“While reconsidering the case of petitioner, the respondents would also take into account Government Order No.Home-(P) of 1999 dated 08.07.1999, whereby Abdul Rashid Baba and N P Singh had been granted a second out-of-turn promotion. Let the relevant orders with regard to the promotion/confirmation of petitioner from a retrospective date be passed within a period of two months”, High Court had directed.
After hearing Advocate Sumit Nayyar for the petitioner whereas Advocate Virender Dev Singh vice Sr. AAG Monika Kohli for the respondents, Justice Sindhu Sharma issued notice. “The compliance report, if any, be filed by or before the next date, failing which Director General of Police shall appear in court on the next date of hearing”, High Court has directed in the contempt petition.
