HC directs Finance Secy to appear in person “

JAMMU, Aug 1: In a petition filed by Suresh Kumar Raina seeking regularization of daily wagers, State High Court has directed Principal Secretary, Finance Department to appear in person.
Advocate Ashok Mishra appearing for respondents sought more time to report compliance of the direction issued on September 24, 2010 stating that the respondents had moved the Law Department to seek advice as to whether a casual labourer could be regularized in service in terms of SRO 64 of 1994.
After hearing Advocate Sudershan Sharma appearing for the petitioner, Justice J P Singh observed, “since a statement has been made on behalf of the State Government before a Division Bench that the directions would be complied with in two months, seeking advise from the Law Department on the issue does not appear bonafide”.
With these observations, the High Court declined the request of the counsel for the respondent for adjournment and directed Principal Secretary Finance Department to appear in person.
