Srinagar, Apr 26: High Court today directed the police to assess the threat perception to the Sarpanch’s family who has been killed by the militants and take decision in the matter on the basis of threat perception report.
The petitioner Nusrat Jan approached the court for Government accommodation and protection in view of threat perception to her and her family. Petitioner-Jan projected that her husband, Shabir Ahmad Mir was a Sarpanch of Panchayat Halqa Odura Tehsil and District Kulgam and District general secretary OBC Morcha BJP Kulgam.
She submitted that her husband and his family were allotted a secured accommodation in Room No. 111 at Hotel Snow Peak Srinagar. The husband of the petitioner was killed by the militants in March this year. The Senior Superintendent of Police, Security J&K, Jammu, has cancelled the accommodation allotted to the husband of the petitioner, thereby exposing her and her children to grave security risk.
Justice Sanjeev Kumar after having regard to the nature of the controversy involved directed the Additional Director General of Police Security, Jammu and Kashmir, Srinagar, to assess the threat perception, if any, to the petitioner-Jan and her family having regard to the fact that her husband, Shabir Ahmad Mir and elected Sarpanch stands already killed by the militants.
The Additional Director General of Police Security, J&K, Srinagar court said, on the basis of threat perception report, shall proceed in the matter and take a decision as to whether the petitioner is entitled to retain the accommodation which was earlier allotted to her deceased husband.
“Let a decision be taken by the Additional Director General of Police Security, J&K, Srinagar, within a period of six weeks from the date a copy of this Order along with writ petition is served upon him. Till such time the decision is taken, the petitioner shall not be evicted from Room No. 111 of Hotel Snow Peak Srinagar”, Court directed.
The petitioner-Jan claimed that she has approached the Additional Director General of Police Security, Jammu and Kashmir, Srinagar, through the party of her husband and has been recommended for retention of residential accommodation allotted to her husband.
Court viewed that whether or not, the petitioner too faces security threat, cannot be determined by this Court and said that it is for the respondents to assess the threat perception to the petitioner and her children having regard to the fact that her husband was a political worker and elected Sarpanch of Panchayat Halqa Odura, who was killed by the militants on March 9, 2022.
