HC directs for equal treatment to transgenders

Srinagar, Nov 30: High Court today said the transgenders are entitled to same protection and medical treatment as any other person and directed the authorities to ensure that no administration denies the equal treatment to them.
The Division Bench of Chief Justice Gita Mittal and Justice Sanjeev Kumar after being informed by the petitioners that the transgenders are being refused any protection by the police and treatment by the hospitals when they approach for the same, directed the police personnel, doctors and hospital administration to ensure equal treatment to them.
The petitioners highlighted the manner in which the transgender community is being treated in the State of Jammu and Kashmir and court said that rights of persons including the transgenders must be protected.
Court has been informed by State counsel that the authorities in the State of Jammu and Kashmir have taken into consideration copies of these policy decisions which have been made available by the writ petitioners.
He further informed the court that so far as the issue of finalization of policy, regarding the upliftment of the transgender community in the State of Jammu and Kashmir is concerned, the draft policy stands forwarded to the Department of Law and Justice and the matter is awaiting decision.
“Let this matter receive urgent scrutiny by all the concerned departments of the Government and the report in terms of the orders already passed be placed before us before the next date of hearing”, DB directed.
