HC directs for tracing baby

SRINAGAR, Sept 4: As the police could not trace and produce the 20 days old baby before the court, High Court today while reiterating its previous directions, directed for implementation of orders.
The child as per the contentions of mother has been taken away by her in laws and the court in this connection had directed the Senior Superintendent of Police, Srinagar, to take all measures, whatever are necessary, to ensure recovery of the female child of the petitioner from the private respondents with the further direction to assign such duty or may be accompanying him shall be authorized to raid any place and household they may suspect the child has been confined in or kept hidden.
In compliance with the direction, the SHO, Police Station, Nishat, Srinagar, had raided different suspicious locations, including the house of the grandfather of the infant. It is reported that the searches/raids were conducted in presence of Executive Magistrate, 1st Class, Khanyar, Srinagar.
When the matter came up for further consideration today, nobody appeared for the private respondents as also the infant baby girl has not been produced before the Court.
Court has been informed that the child could not be recovered as yet, as the private respondents have gone absconding.
Government counsel has sought time to submit the report in compliance with the directions passed by this Court on 31.08.2021 read with order dated 01.09.2021. Time sought was granted. Court directed for submitting of report with regard to recovery of the infant on Monday, viz 06.09.2021.
Justice Ali Mohammad Magrey during the proceeding of the case said the endeavour and the effort of the Police team supervised by the Superintendent of Police, East Zone, Srinagar-Tanushree to trace out the infant baby girl is on.
“However, the endeavour should result in recovery of the child before anything untoward happens to her, as suspected by the mother of the infant and recorded in the order passed by this Court on 01.09.2021”, Court added.
“The Court need not to reiterate the directions passed on 31.08.2021 and 01.09.2021, copies whereof have already been furnished to the Police concerned, through B. A. Dar, Sr. AAG, but a word of concern qua delay in recovery of infant baby girl for which the mother is desperate, be registered and there shall be no doubt in the mind of the Court not to believe the Police for taking all efforts out to do the needful”, Justice Magrey said.
