HC directs for tracing, producing baby before court

Srinagar, Sept 1: High Court today directed the police to recover 20 days old baby from the in-laws of her mother and produce it before the court.
The mother of the baby has approached the court for recovery of her child which has been taken away by her in-laws. The court after hearing the petitioner in persons said, it cannot act as a mute spectator but, in the interest of justice, necessary measures need to be taken to save the life and health of the child and with a view to doing so, it becomes imperative to secure her recovery and save the mother from the agonizing situation she has been put to.
Court in this connection had directed the Senior Superintendent of Police, Srinagar, yesterday to take all measures, whatever are necessary, to ensure recovery of the female child of the petitioner from the private respondents with the further direction to assign such duty or may be accompanying him shall be authorised to raid any place and household they may suspect the child has been confined in or kept hidden.
When the matter came up for further hearing today nobody appears for the private respondents. The suckling baby girl has also not been produced before the Court. Sr. AAG, stated that the child could not be recovered as yet as she was not found at the residence of the private respondents.
He sought permission to place on record the police report in this regard in compliance of the direction passed by this Court on 31.08.2021. Court granted permission to him. The report produced was taken on record, copy whereof shall be provided to the counsel for the petitioner.
Perusal of the report reveals that the District Police Headquarter, Srinagar, on receipt of the Court order dated 31.08.2021, have directed SP, East Zone, Srinagar, to implement and execute the order in letter and spirit.
In compliance to the direction, the SHO, Police Station, Nishat, Srinagar, has raided different suspicious locations, including the house of the grandfather of infant. It is reported that the searches/raids were conducted in presence of Executive Magistrate, 1st Class, Khanyar, Srinagar.
“The endeavour and the effort of the Police team supervised by the Superintendent of Police, East Zone, Srinagar, namely Tanushree, is appreciable. However, the endeavour should result in recovery of the child before anything untoward happens to her or is done with her, as suspected by the petitioner”, Court said.
Justice Magrey added that the Court is not powerless and the conduct of the private respondents is also likely to bring others into the dragnet of abetment of the crime. “In this view, the Police is directed to accelerate their efforts to search for and recover the baby in tune with the spirit of the anxiety of the Court expressed in the directions passed by this Court”, reads the order.
Court said, the Superintendent of Police, East Zone, Srinagar, if required, shall be free to approach the Director General of Police/Inspector General of Police, Kashmir Range, for making available such electronic and/or technical help including coordination of the Cyber Crime Police as may be helpful in tracing out the location of the child and the hiding private respondents.
