JAMMU, Oct 11: In a petition filed by one Sanjay Sharma seeking quashment of the order of Special Municipal Mobile Magistrate Jammu which was upheld by the Principal Sessions Judge also, High Court today directed the Investigating Officer to record the statement of a girl, who set herself ablaze at Zanana Park.
After hearing Senior Advocate Sunil Sethi with Advocate Ravi Abrol appearing for the petitioner, Justice Janak Raj Kotwal issued notice. Advocate AK Sawhney accepted notice on behalf of private respondent.
Justice Kotwal also directed that Investigating Officer shall go ahead with the recording of the statement of the victim in terms of Section 161 CrPC read with Section 164-A CrPC making it clear that there is no bar in recording the statement of a person even if FIR has been registered on her statement.
“This observation is, however, subject to final outcome of the petition”, the High Court said.
