Srinagar, Oct 11: High Court today directed two owners of a building to file an undertaking for demolition of a part of their building in which objection has been raised by Srinagar Municipal Corporation.
A Division Bench of High Court comprising Chief Justice, M M Kumar and Justice Ali Mohammad Magray directed two building owners to file an undertaking for demolition part of the building in which objection has been raised by the SMC and also to the effect that they will not use the building for any other purpose except for which permission has been granted.
The Bench was hearing the application of those whose buildings have been sealed by SMC under the direction of court order passed in a Public Interest Litigation (PIL) filed by Mujeeb Andrabi against the State.
The court directed the undertaking shall be filed with the registry of this court.
The Bench further directed that notice which has been placed in press instigating the public to stop organization against lawful order shall be stopped immediately and learned Amicus (Riyaz Ahmad Jan) and learned counsel for petitioner (Firdous Ahmad Parray) may bring to the notice of the court any such violation so that suitable action will taken.
SMC authorities have sealed about 45 buildings in the Srinagar city on the direction of the court orders passed previous month wherein court directed sealing the buildings against which SMC had issued show cause notices in 2009 and also in 2013.
