Srinagar, Nov 18: The State High Court today took strong note of disobeying of its orders by Government officials and has sought personal appearance of Director General of Police (DGP) and other top officials if they fail to file compliance.
Justice MH Attar while hearing a contempt petition filed by one Ghulam Nabi Dar (Retired DySP) for implementing the judgment passed by the Court in 2012 has sought compliance report from Commissioner/ Secretary to Home Department and Director General of Police. The court in the judgment had directed the authorities to consider the case of Dar for next higher promotion.
Dar in his third round of litigation seeks implementation of final judgment which has been passed by the court about 4 years ago and till date the authorities are yet to inform the court about the implementation of the judgment or otherwise.
Court has granted four weeks last and final opportunity to Commissioner/Secretary to Home Department and Director General of Police for implementing the judgment and filing of compliance report.
“In default, respondents (Commissioner/Secretary Home and DGP) to appear in person before the court on next date”, directed Justice Attar as he also asked their counsel to inform them about the court order.
In another contempt petition, titled Mohammad Afzal Khan versus Mir Javed Jaffar, Court directed Executive Engineer, Irrigation Division Anantnag and Assistant Commissioner (Collector Land Acquisition) Anantnag to appear in person before the court along with record of the case on next date. In this case, Khan submitted that their proprietary land has been acquired by the authorities and till date no amount as entitled has been paid to them.
In yet another case, the court sought personal appearance of Commissioner/Secretary Technical Education on next date of hearing in case compliance report is not filed as was directed earlier. “In the interest of justice last opportunity of two weeks is granted for filing report”, Justice Attar said.
