Srinagar, Nov 6: Jammu and Kashmir High Court today directed the Registrar Judicial to frame a Robkar and secure presence of Commissioner/Secretary and Director Social Welfare Department (SWD) by “coercive” method in contempt of case.
A Single Bench of the High Court comprising Justice Ali Mohammad Magray also directed bailable warrants to the tune of Rs. 20,000 each for every contemnor be issued and executed by Inspector General of Police.
Hearing a contempt petition filed by Parveeza Banoo seeking implementation of the court’s judgment in which the SWD Department was directed to adjust Banoo as Anganwadi worker.
In its earlier judgment, the court had directed the petitioner was entitled in all circumstances for reckoning of the service from the date of her joining report.
The court also directed the SWD to pay honorarium to the petitioner form today.
“Prima facie case of contempt is made out, therefore, the respondents are required to show cause as to why contempt proceedings shall not be initiated against them,” the court said.
The court also said the judgment of the present contempt has attained finality an no appeal has been filed as submitted by counsel for respondents, Tariq Ahmad Lone, Advocate General.
Taking serious notice of the SWD, the court said the respondents instead of implementing the judgment of the court have rather discussed the merits of the case as if they were sitting in appeal against the judgment.
